Poster Boy For Frivolous UDRP Cases: Booked.xyz Guilty Of RDNH: TM Filed 16 Yrs After Domain Was Registered - Booked Ltd of London which owns the domain Booked.xyz and Bookedxyz.com was just found guilty of Reverse Domain Name Hijacking on the domain name Booked.com in one of the most baseless UDRP cases we have ever read.
Its too bad there is not any penalties for those who bring frivolous UDRP cases other than a finding of Reverse Domain Name hijacking which the three member panel rightfully found.
The domain owner represented himself in the UDRP which is just silly on its face.

Photo.com – sole for over $1 million twice – saved in UDRP - Complainant makes interesting allegations in UDRP.
A three person WIPO panel has handed down a decision in a UDRP for Photo.com in a case I wrote about in October.
The complainant owns Foto.com, but there’s a lot more to the story than just a company using UDRP to go after a great domain name.

MomAndMe.com spared in UDRP. Should have been RDNH? - Indian company should not have brought case.
A single member World Intellectual Property Organization panel has ruled against Mahindra Mahindra Limited of India in its UDRP against the owner of MomAndMe.com.
Even though the domain name owner didn’t respond, this case should have been a candidate for reverse domain name hijacking.
The complainant claims rights dating as far back as 2007. The domain name owner appears to have registered the domain name in 2000. Case closed.

Domain Trump has filed a UDRP on the domain name Trumpcard.com
The domain name TrumpCard.com was first registered in 1998.
While the Donald owns some casinos or at least has his name on them, the term Trump Card has a meaning well before the time there was a Donald Trump and well before he ever owned a casino.
The domain is owned under privacy since 2011.

The extremely generic domain name Fiesta.com has been hit with a UDRP filing.
The complainant is Dean Simmons, Sàrl Heintz Van Landewyck S.à.r.l. which as the best as I can tell has a pending but not yet registered trademark on the term and is actually facing abandonment by April 2015.
Del Monte foods also has a recently filed trademark on the term Fiesta going all the way back to May 14th 2014.

eBay wins a massive UDRP case.
eBay has successfully taken down over 1,000 domain names containing its trademark, many of which were set up as commerce sites.
The online auction company filed a UDRP against the owner of 1,153 .com and .net domain names. All of the domain names contained “ebay” followed by a series of numbers, such as ebay962.com, ebay623.net and ebay389.com.

After 14 Years Porsche Finally Gets Around To Filing & Winning UDRP On Porsches.com - Its pretty hard to believe but it took the car maker Porsche over 14 years to go after the domain name Porsches.com
The domain name was registered on March 13, 2000
The domain name is of course the plural of the car makers name properly spelled
A pretty bang on trademark issue.
However the UDRP wasn’t filed until October 23, 2014.

We read through the complaint the other day thought is was a no-brainier win for the domain holder, but as the opinion lays out it seems the three member panel thought it was a no-brainier win for the Trademark Holder.
