Worst of 2010: UltimateGuitar.com Taken In WIPO Based On “Common Law” Trademark Of A Hyphenated Domain - In a case which was decided about a month ago, but just brought to my attention by a reader today, a one person WIPO panel took the domain name, UltimateGuitar.com away from Domain Capital which financed it on behalf of an undisclosed owner and gave it to the owner of Ultimate-Guitar.com, based on a “common law” trademark. This decision has  made it onto my worst of 2010 list. Here are the facts. Complainant’s owns the domain ultimate-guitar.com which was created on October 13, 1999. The ... read more ...

UDRP Watch: Buzz Aldrin, Manny Ramirez, and Brazilian Finance Follies - Celebrities, parking woes, big companies, and more. Here are a few recent UDRP filings and decisions of note. European Court of Justice Rules That Using Trademarks In Adwords Is Not Trademark Infringement, Again - Europe’s Court of Justice has confirmed that use of a competitor’s name as an Internet advertising keyword does not constitute a violation of European trademark law. The case involved two companies Primakabin and Portakabin, which both manufacture temporary sheds and buildings. Primakabin used keywords like “portakabin” and mis-spelled variants “portacabin” in keywords it used with Google AdWords in order to draw users to Primakabin products when they searched for its competitor. If A .US Domain At Best Is Only Worth 1% of a .Com and 25% Of A .CA Why Bother? - I’m sure this will piss off a whole group of folks who invest in .US domains, but looking through the Snapnames.com .US domain auction closing tomorrow , July 8th at 3:15pm, I couldn’t help but notice that Slots.Us is at auction with a reserve of $58,830 or roughly 1% of what the .com just sold for, or just over 25% of what Slots.ca just sold for. Candy.US is another domain for sale in this auction with a reserve price of just over $14K. We all know the Domain King sold Candy.com for $3M, making ... read more ...

Moniker Auction Results: 30 .Us Domain Name Sell - US country code auction sells over $40,000 worth of domain names. [Updated: the official tally is 30 domains sold. I originally reported 29 domains sold.] Moniker’s .us domain name auction sold 29 30 of 86 domain names, or 35%. That’s a much stronger showing than recent online auctions held by the company. The key to success was a lot of good keyword domain names with low reserves. Having them at prices most people can afford helped, too. In total over $40,000 ... read more ...

Just two days after WhyPark released its new Domain Apps, customers have installed 7,000 apps on their WhyPark domain names, WhyPark founder Craig Rowe told me this morning. Moniker Releases Domain Auction Catalog for NYC (Already) - Catalog issued well in advance with some big names. One of my (and others’) complaints about live domain name auctions is that the catalogs are released at the last minute. That hardly gives time for serious buyers to pull together the necessary money or approval to make big purchases. But Moniker just released the auction catalog for its August 18 auction at DOMAINfest NYC. That’s a refreshing change. The list of domains includes some of those big dollar domains ... read more ...

How Long Will It Be Until FaceTime Is Used For Adult? Looks Like Sept 1: Is It A Game Changer - If you haven’t heard about Facetime its part of the new iPhone and allow you to see the other party your talking to, kind of like Skype does with a computer but unlike Skype you won’t have to accept a permanent invitation from someone that lets them see when your always online. What Idiot Made Rape.Tv & Incest.Tv, Premium Domains? & Why Would VeriSign Want To Profit From Them? - So I got my panties in a wad over two previously “premium” .TV domains which dropped over the last two days and now carry an annual one time premium fee for registration. The two domains are Rape.Tv and Incest.Tv. I’m amazed that someone actually put the premium label on them and put a premium price on them. and at that a public company. Yes as you know VeriSign owns the Dot Tv registry. By putting  a “premium” label on these domains VeriSign is charging premium prices for each domain, ... read more ...

Network Solutions Raising Prices By $.50 “Blaming Registry Increases” - I got the following notice from NetworkSolutions.com over the weekend stating that they are raising the price of their registrations on August 6th by $.50 for several extensions. Of course all registrars are entitled to charge whatever they want to an end user for a domain, but I’m bothered by the statement in the notice blaming the price increase,  on increases by the respective registry’s. We all know that Verisign increased the prices of .Com’s .Net’s by 7% on July 1, 2010, but the notice ... read more ...

Domainer Call to Action: An Important ICANN Comment Period - You should comment on this proposed new procedure for hijacked domain names. It’s rare that I ask the domain community to comment on a particular topic at ICANN. It’s even rarer that domain investors actually follow through. But there’s an important process going on to establish a mechanism to return hijacked domain names, and your input is needed. That a process to return stolen domain names is in the works is a good thing. We hear every day about stolen ... read more ...

How to Maximize Chances of Getting .Co Domains, and during Lowest Prices - Here’s how to maximize your chances of getting the .co domain names you want — without breaking the bank. .Co domain name registration will be open to the public July 20. But if you want to get a good domain name, you’ll need to pre-register the domains prior to the general release. On July 20 the registrars will be pinging the .co registry servers like mad in a bid to get domains that were pre-registered. Going at it by hand will be difficult. Each registrar ... read more ...

Why New TLD Applicants Are Excited About .XXX - Hint: It has nothing to do with the actual TLD. Were you surprised to see so many new TLD applicants advocating for ICANN to approve .xxx at the ICANN meeting last month? Regardless of their thoughts on the top level domain name and the process, they had their reasons. I had caught wind of this a couple weeks ago, but Antony Van Couvering of Minds + Machines spells it out in explicit terms in a recent blog post: The Board’s decision to green-light .XXX means new ... read more ...
