Troubling: Domain Awarded By UDRP With No Trademark Based On $1K Bank Account, Flyers & 61 Customers - In what I consider a very troubling and horrible decision, A one member UDRP panel has awarded a domain names welldonebbqs.com and welldonebbqcleaning.com to a Complainant who didn’t have a registered trademark, on the basis doing a whopping $11,000 in gross revenue, having $1,000 in a bank account and distributing 2,000 flyers. I have comments that follow this really bad decision. “Complainant is a young man who, whilst still at University, enrolled in the Province of Ontario’s Summer Company ... read more ...

This is funny: SM.net UDRP claims domain couldn’t be associated to porn - A rather curious argument in a UDRP for SM.net. Spanish education publishing company Fundación Santa María-Ediciones SM has lost a UDRP it filed against the owner of SM.net. Although the company’s trademarks include the term “SM”, it only makes up part of its marks. Thus, the panel ruled that the domain name was not confusingly similar to a mark in which the complainant had rights. Nothing earth shattering here. But this is what I found amusing. The Complainant ... read more ...
