The ICANN IRT needs a lesson in getting buy-in.
Implementation Recommendation Team (IRT) was set up by trademark interests to come up with a way to protect trademark owners during the launch of new top level domain names. The process by which it was set up and operated could be a case study in how not to get buy-in for a new idea.
I’ve worked with a lot of teams over the past dozen years and have had to sell ideas many times. I’ve managed groups of union workers, ... read more ...
An Open Letter to Rod Beckstrom -
An open letter to the new CEO of ICANN.
Congratulations, Rod. You’ll be the new CEO of ICANN.
You have your work cut out for you. Rightly or wrongly, ICANN is a punching bag for many grievances. As Michael Palage pointed out at the last ICANN meeting, ICANN will likely be subject to many lawsuits over the next couple years. Here are a few suggestions as you prepare to take over the reins.
1. Remember that domain owners ultimately fund your organization. ... read more ...

National Arbitration Forum FAIL -
Double jeopardy comes to UDRP.
Last week I wrote about a WIPO domain arbitration case in which a complainant refiled a case after losing the first time. The arbitrator ruled that the complainant didn’t include any information in its refiled case that it couldn’t have discovered and filed in its original case. So he dismissed the case.
But over at National Arbitration Forum double jeopardy is alive and well.
On April 6, an arbitrator ruled that Traditional ... read more ...
Facebook Usernames Set Dangerous Precedent -
An entire industry was created out of what many claimed was a near criminal act of extortion, calling it cybersquatting, a term even Network Solutions referred to concerning individuals and companies that register domain names on speculation that someone who wasn’t savvy enough to register the character string when it was available would be interested in buying it later.
Once Congress got ahold of the issue and legislated what the term means, the meaning changed. Now it’s called ... read more ...

One funny thing about politicians is how they make short-sighted maneuvers that end up costing their constituents in the long run. One example is requiring online merchants to collect sales tax for shipments to their state if the company has any affiliates in the state.
The sad thing is that North Carolina, the latest state set to ponder such a law, can just look at other states to realize this is a mistake. ... read more ...

CrapShoot: Man Rolls Dice on Casinos.org -
Man files UDRP for domain name Casinos.org.
To be fair, it was early this morning that I first saw an arbitration filing for the domain name Casinos.org at WIPO.
I rubbed my eyes. This must be a joke, right? Perhaps there was more to the story, I thought. I looked up the history of the domain, and it appears to be owned by the same person for a couple years. Something just didn’t seem right.
I emailed the owner of the domain to ask him what was going on. ... read more ...
