20 Years Later, Janet Jackson Gets Rhythm Nation Domain Name -
Janet Jackson wins domain name at arbitration.
You can excuse Janet Jackson for not registering the RhythmNation1814.com domain name when she originally released her hit album. After all, it was 1989 when Jackson released the album with #1 hits “Miss You Much” and “Escapade”. Domain names weren’t on top of most peoples’ minds back then.
Nonetheless, Jackson’s company probably should have thought to register the domain before the current registrant ... read more ...

Google Steps Up Domain Name Arbitration Cases -
Google steps up domain trademark enforcement for its brands.
After many years of using domain arbitration as the last resort for picking up trademark domains, Google has gotten involved in the domain arbitration process in a big way this year. Either it is changing its trademark domain recapturing process or the number of AWOL trademark registrants is on the rise.
When Google filed a case for GoogleAdwords.com last year, my question to Google was ‘what took you ... read more ...
Atlanta.com Mistakenly Named in Domain Dispute -
Atlanta.com included in UDRP by accident.
My heart skipped a beat today when I saw that Atlanta.com had been served with a domain arbitration notice. But then I quickly figured out that this is some sort of clerical error.
Automobile Atlanta, Inc. filed a case with National Arbitration Forum for six domains including automobileatlanta.com, autoatlanta.net, automobileatlanta.net, dr914.com, and lifeinhighgear.com. Oh yeah, and a minor domain name called Atlanta.com ... read more ...

Walmart files for domain arbitration, but not against the actual web site.

Well, there was an interesting twist today. Walmart filed a case, not against the actual PeopleofWalmart.com site, but against a typo of it: PeapleofWalmart.com (notice the a instead of o).
It should be a slam dunk case for Walmart, given that ... read more ...

Australian Company Wants .Com, Gets Nailed for Reverse Domain Hijacking -
Web site company apparently doesn’t understand domain names.
An Australian web site development company, Bwired Group Pty Ltd, has failed in its attempt to get the domain name Bwired.com through arbitration — and was found guilty of reverse domain name hijacking.
There are two interesting things about this case. First, it shows that companies can’t rely on their country code domain name alone — they still need .com. Bwired uses bwired.com.au as its domain. ... read more ...

Three letter domain name awarded to bank.
An arbitrator with World Intellectual Property Organization has awarded the domain name DKB.com to Deutsche Kreditbank AG. The owner of DKB.com, DKB Data Services, had invalid contact information and may have been dissolved — which probably explains why it didn’t respond to the complaint.

Arbitrator Rains on Media Rain’s Parade -
Utah company loses its frivolous UDRP complaint.
No surprise here. But still a sad, abusive story to report.
Media Rain, LLC has lost its arbitration proceedings in which it tried to obtain the domain name Rain.com.
The facts were quite damning. Rain.com was registered back in 1990, 18 years prior to Media Rain’s formation. Verio acquired the ISP that owned Rain.com in 1996.
But Media Rain, which uses the domain name MediaRain.com, wanted to get its hands ... read more ...

Not-So-Uniform Domain Dispute Resolution Policy -
Inconsistency in UDRP decisions.
Officially, UDRP stands for Uniform Domain-Name Dispute-Resolution Policy. But sometimes it seems it should be called various-form, or not-uniform. How arbitrators decide cases can be a crap shoot.
Here’s a recent example: ChinaDiesel.com. The complainant lost the case. But what’s interesting is how the arbitrator approached the first requirement of UDRP:
“the domain name registered by Respondent is identical or confusingly ... read more ...
