The domain is owned by the Democratic Congressional Campaign Committee (DCCC) who has been using it for less than flattering  purposes but what the panel found to be protected political speech. Three Letter .com; NGF.com Gets Hit With A UDRP - Another three letter .com just got hit with a UDRP. The domain name is NGF.com which is owned by Mediablue of Hong Kong. The complainant is unknown at this time. The domain is parked with Internet Traffic and is pulling results for a divergent group of topics including golf. NGF.org is owned by the National Golf Foundation which holds two US trademarks for the term NGF in the US, so that’s my pick at the moment for whom the complainant is most likely to be, although those three letters stand for ... read more ...

Fire your UDRP lawyer, Thursday edition - I could have saved this complainant some money. Here’s an easy way to waste a few thousand bucks: file a UDRP against infringement on a subdomain. This is easily one of the weirdest claims I’ve seen in a while and it involved the domain names windoows.net and windooows.com. The domains are clearly typos of the term “windows”, although they are used as lead gen sites for house windows, not Microsoft Windows. And it wasn’t Microsoft that filed the complaint; ... read more ...

A National Arbitration Forum panelist has ruled that the owner of Oogle.com can keep his domain name despite Google’s claims that the registration of the domain name amounts to cybersquatting. Google claimed it was 2004; ... read more ...

The Generic Domain Name MedicalPark.com Lost In A UDRP - The domain name MedicalPark.com was just awarded to a trademark holder Freiberger Holding GmbH (“Complainant”) in a UDRP. The domain holder didn’t respond to the complaint yet the one member panel did some very broad over reaching in my opinion and not even consider the fact that the term “medical park” is a term often used by thousands if not tens of thousands of business and centers around the world. Instead of looking at the case and the term the panel took the word of the complainant ... read more ...

NYC condo house of directors fails to take down dispute site - Resident set up site to complain about board of directors. From what I’ve heard, the boards of directors of many New York condos and co-ops would make for great reality show fodder. Here’s just one example: The board of directors of Towers on the Park Condominium filed a UDRP against a resident who registered TowersonthePark.com and used it to criticize the board. The resident, Paul Adao, created a web site to complain about various activities of the board of ... read more ...

The domain was first registered in 2002 and is currently under privacy. The domain name goes to a parked page full of references for Oxford Dictionary. “Occupy” is a new “Sucks” - The term “occupy” can be similar to “sucks” in a domain name — an indication of a gripe site. The first element of the uniform domain name dispute resolution policy (UDRP) that a complainant must prove is that the domain name is identical or confusingly similar to a trademark in which the complainant has rights. But what about when it comes to satirical or gripe sites? Generally speaking, the first element of the policy can be overcome by the respondent ... read more ...

Brothel beats Victoria’s Secret in titillating domain name dispute - …and it’s seriously a fascinating UDRP case. An Australian brothel has rebuffed an attempt by lingerie retailer Victoria’s Secret to take its domain name VictoriasSecrets.com.au. The decision was handed down on a couple weeks ago and a Domain Name Wire reader just brought the case to my attention. The subject matter certainly makes for an interesting story, but the story goes much deeper than that. Let’s get the fun stuff out of the way: the respondent sent ... read more ...

DoorKings.com: this is because we sinecure a domain profession for UDRP - A complainant’s UDRP filing should be pretty simple, if it knows what it’s doing. John Berryhill was ready. So he dutifully explained that, as a reseller meeting certain conditions, United Marketing Group had rights or legitimate interests in the domain names. Then ... read more ...

Lance Armstrong’s quarrel opposite USADA reminds me a lot of a arguments opposite UDRP - Not enough time to respond to “kangaroo court”. Lance Armstrong is fighting hard to not have to defend himself against the U.S. Anti-Doping Agency (USADA), which he calls a “Kangaroo court”. Armstrong wants nothing to do with the USADA process, so he’s trying to short circuit it by going to the courts. A lot of domain name owners have had it with UDRP, so they do the same thing. His arguments sound a lot like the arguments made against the uniform domain ... read more ...
