National Arbitration Forum records show that, since December 29, the company has won arbitration cases for at least 40 domain names. The first batch of domains the company won on December 29, 2009 were typical typos, including ... read more ...

Study Shows Million Dollar Domain Arbitrators and UDRP Bias - Study sheds light on potentially biased appointment of UDRP arbitrators. For the past few weeks I’ve been working with an outside party to analyze the distribution of WIPO cases amongst arbitrators. Now attorney Zak Muscovitch has beaten me to it with National Arbitration Forum data. For those that follow NAF cases, you won’t be surprised to learn what Muscovitch discovered. But it’s still startling. One controversial panelist has heard about 10% of all cases: ... read more ...

New UDRP Goes into Effect Today – Still No Response from ICANN - Yes, we do disagree on that. I think that if we *had to* balance the interests, I do not hold domain owners up as more important than ethical and free trade. But, I can respect your position as being simply one of differing values. However, I don’t see that any legitimate registrants could possibly be harmed by this. *Legitimate* registrants are those who stay far from others’ IP rights and who update their Whois information. Seems kind of easy to do. Also, I disagree with ... read more ...

Roche, Lego, and Google File Most Domain Arbitration Cases in 2009 - Top UDRP filers for 2009. Here’s a message to all the cybersquatters out there: don’t mess with the companies on this list. Using data from UDRPSearch, Domain Name Wire tabulated the total number of UDRP cases filed by these companies in 2009. This isn’t as easy as it sounds, given that both WIPO and National Arbitration Forum use different names for some companies, and some companies even use multiple names when filing cases with the same provider. Furthermore, ... read more ...

Panel Hands VisitNorway.us to Owner of VisitNorway.com - A warning to owners of “Visit” domain names. A National Arbitration Forum has handed the domain name VisitNorway.us to Innovasjon Norge, dba Innovation Norway, which owns the domain name VisitNorway.com. The basis for transfer is that the complainant owns common law rights to the term “VisitNorway”. It has applied for a U.S. design trademark for the term, but it is still pending. This case was a bit disturbing, so I did a little digging on “visit location” ... read more ...

Is eHelper.com a Typo of EdHelper.com? - When is a typo not a typo? Is eHelper.com a typo of EdHelper.com? Yes, according to National Arbitration Forum panelist Sandra J. Franklin. In a decision handed down yesterday, Franklin awarded the domain name eHelper.com to the owner of EdHelper.com. It’s a strange decision since eHelper is fundamentally different than EdHelper. It’s not a typo in the same way EdHlper.com would be, and eHelper.com is a legitimate, stand alone name for a possible web site. ... read more ...

Dubai Law Firm Nailed for Reverse Domain Name Hijacking - Law firm found guilty of abusing UDRP. It’s bad enough when anyone tries “reverse domain name hijacking” through domain arbitration. It’s worse when the culprit is a law firm. But Bin Shabib Associates of Dubai tried just such a stunt, filing a case for BSA.com. A three person National Arbitration Forum didn’t buy it. Bin Shabib Associates argued that it had rights to the term BSA on the basis that it has filed a trademark application in the United Arab ... read more ...

NMC.com Domain Name Spared during Arbitration Despite No Response - Prolific panelist makes the right finding (this time). National Arbitration Forum panelist Carolyn Marks Johnson is no friend of domain name owners. An early study of arbitrators found that she was one of the most prolific and biased, finding for complainants 97.2% of the time (compared to the typical 82.9% at the time). She was also recently sued for alleged judicial misconduct. But she managed to find for the respondent on NMC.com, despite the respondent not filing ... read more ...

Prank Dialer Gets Rick Rolled in Domain Name Dispute - Prank dialing services fight it out in UDRP. After starting prank dialing service PrankDial.com, Fahim Saleh was a little miffed that another site called PrankDialer.com came along. So he filed for domain arbitration against PrankDialer.com owner Trey Glauser, who also has a handful of similar domains. Saleh’s argument for trademark rights to PrankDial.com were rather weak, and the common term certainly wouldn’t hold weight against PrankDialer.com. The arbitrator ... read more ...

Tenant Dispute Over HomeAwayfromHome.com - Well written article. I also think, that HomeAwayFromHome.com is the better name. This does show us, that long domains names can make sense, and be better than a shorter one. If I am allowed, to say this: I guess, if had created a such a name, with the same words, I probably would of looked like this: home-away-from-home.com, which I personally would favor, as homeawayfromhome.com is more difficult to read and understand.
