The registry sold the domain name to McClure (who also runs Coffee.org) for $100,000 as part of its Startup.club program. With this program, McClure will pay the domain off over 10 years and .Club will provide marketing support.
.Club CEO Colin Campbell and CMO Jeff Sass are on the Domain Name Wire Podcast on January 5, and they’ll talk a bit about how this deal came together and how they were able to help McClure launch the site just one month after striking the deal.

Can someone please explain how Coffee.Club is not infringing on the exact match trademark Coffee Club?….What am I missing?

@Aaron … maybe because “Retail Store *and* Mail” is different from “Online Store and Mail” ? … maybe if the original tm said “Retail Store *or* Mail … that would be a partial exact match. im just guessing … i think the idea is brilliant regardless ..

Coffee Club looks like descriptive use (and therefore Fair Use) to me.

Thanks Jennifer – The domain name, without content, is definitely descriptive and fair use. The particular issue that is concerning would be the Goods and Services offered on the website is very similar to the Live Trademark…….I certainly wish them the best regardless……..

Added note: The (R) TM “Coffee Club” filed in 2003 was abandoned in 2004: http://trademarks.justia.com/782/85/coffee-club-78285335.html Furthermore, a search for “Coffee Club” in the Official U.S. Trademark database returns no results: http://tmsearch.uspto.gov/bin/gate.exe?f=searchss&state=4810:3nytmm.1.1 – However, Just because the (R) TM was abandoned, it doesn’t mean a TM doesn’t exist. Furthermore, it is possible for multiple TM’s to exist legally from multiple businesses in the same industry as long as the marks are clearly distinguishable and can’t be confused for one another. A common example of such multiple marks would be mechanic shops such as but not limited to “Bob’s Garage, Tire Shop, etc.” Multiple marks such as those with identical words, yet different supporting graphical elements exist in different U.S. states under different TM holders legally. (This information is in no way legal advice and everyone is advised to do their own research and consult with a licensed IP / TM attorney.)
